No court shall take cognizance of any offence under Section 138 except upon a complaint, in writing, made by the payee or holder in due course, within one month of the date on which the cause of action arises.

In simple terms

A cheque-bounce case must be filed by the payee in writing within one month of the cause of action (expiry of the 15-day notice period).
